About these terms
These Terms and Conditions apply when a person creates an account, accesses or uses SEND Life. By using SEND Life, the member agrees to these terms. A person using SEND Life for a school, organisation or another person confirms that they are authorised to do so.
What SEND Life provides
SEND Life provides tools to organise information, evidence, documents, tasks, routines, appointments, support records and communications relating to SEND and family support.
SEND Life is a support and record-keeping platform. It is not an emergency service and does not replace advice from a doctor, lawyer, teacher, SENCo, social worker, safeguarding professional, local authority or other qualified professional. SEND Life does not decide entitlement to an EHCP, benefits, treatment, education provision or legal remedies.
Accounts and security
Members must provide accurate account information, keep passwords secure and tell SEND Life promptly if they believe an account has been accessed without permission. Members are responsible for activity carried out through their account unless caused by SEND Life's failure to use reasonable security measures.
Members must not allow an unauthorised person to access sensitive records. Child accounts must be created and supervised by an authorised adult.
Information and documents added by members
Members retain ownership of the content they add. By adding content, a member gives SEND Life the limited permission required to store, process, back up, display, export and share it according to the member's instructions and the platform's functions.
A member must have the right and authority to upload, record or share information. Members are responsible for checking that information is accurate, appropriate and lawful before relying on it or sending it to a school, professional, public authority, tribunal or another person.
Ownership and Use of Your Information
All information, documents, photographs, reports, notes and other content that you add to SEND Life about yourself or your child remain under your ownership and control.
SEND Life does not take ownership of the information you upload. Your information will only be processed where necessary to provide the SEND Life service, operate your account, keep the platform secure, provide technical support and meet our legal obligations.
Information entered about a child will not be sold, rented or shared with other organisations for their own marketing, advertising, profiling or commercial purposes.
We will not use information about a child to advertise products, create advertising profiles or train third-party artificial intelligence systems.
Sharing Information with Service Providers
SEND Life does not provide users’ information or children’s records to unrelated third parties for their own use.
We may use carefully selected service providers where they are required to operate and secure the platform. This may include our website hosting provider, database provider, email delivery provider, payment processor and other essential technical services.
These providers may only process information on our instructions, for the specific service they provide, and must protect it appropriately. They are not permitted to use children’s information for their own advertising, marketing or unrelated business purposes.
We may also disclose information where we are legally required to do so, where it is necessary to protect someone from serious harm, or where disclosure is required by a court, regulator or law-enforcement authority.
Cookies and Related Products
SEND Life uses cookies and similar technologies.
Some cookies are essential for the website and application to work properly. These may be used to keep users signed in, protect accounts, remember security settings, maintain a user’s session and save preferences.
With the user’s permission, SEND Life may also use optional cookies to understand how the platform is used, improve the service and show users information about relevant SEND Life features, services or related products that may be useful to them.
Recommendations will be based on information such as website activity, pages viewed, account type or general service interests. SEND Life will not use private documents, medical records, school reports, evidence logs or sensitive information entered about a child to select advertising or recommend third-party products.
Where consent is required, optional cookies will not be placed until the user has made a choice. Users can reject optional cookies or withdraw their consent at any time through the cookie settings on the website or through their browser settings.
Rejecting optional cookies will not prevent users from accessing the main SEND Life service, although some optional or personalised features may not work in the same way.
SEND Life will clearly identify any third-party cookies or services used and explain their purpose within its Cookie Policy or cookie settings.
SEND Life will not use member documentation for advertising, sell it, or use it for unrelated purposes. Uploaded documents are not used to train public AI models.
Acceptable use
Members must not use SEND Life to:
- break the law or infringe another person's rights;
- upload malicious software or attempt to damage, disrupt or bypass security;
- access another member's information without permission;
- impersonate another person or provide deliberately false account information;
- threaten, harass or abuse another person;
- upload content they have no right to hold or share; or
- use automated methods to overload, scrape or copy the service without written permission.
SEND Life may restrict or suspend access where reasonably necessary to protect children, members, the service or legal rights.
Safeguarding and urgent situations
SEND Life is not monitored as an emergency or safeguarding reporting service. In an emergency, contact 999 or the appropriate emergency service. Urgent medical, safeguarding, education or legal concerns must be raised with the responsible professional or authority.
Where SEND Life reasonably believes disclosure is necessary to protect a child or another person from serious harm, information may be handled or disclosed as permitted or required by law.
Availability, changes and backups
SEND Life aims to provide a reliable service but cannot guarantee uninterrupted or error-free access. Maintenance, updates, internet failures, hosting incidents or events outside reasonable control may temporarily affect availability.
Features may be changed, improved, replaced or withdrawn where reasonably necessary. Reasonable care is taken with backups, but members should also keep copies of critical documents and records they may urgently need.
Free access and future services
SEND Life is currently offered as a free platform. SEND Life may introduce optional paid services or change how the service is funded in the future. Members will be told before a new charge applies to an existing account, and no payment will be taken without the required agreement or authorisation.
Liability
Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
To the extent permitted by law, SEND Life is not responsible for decisions made by members, schools, professionals, public bodies or other third parties based on information stored in or exported from the platform. Members must independently check important information and obtain suitable professional advice.
Ending an account
A member may stop using SEND Life and request account deletion. SEND Life may suspend or close an account for serious or repeated breach of these terms, unlawful use, security risk or safeguarding concerns. Where reasonably possible, the member will be given notice and an opportunity to export their information, unless doing so would create a legal, safety or security risk.
Privacy
Use of personal information is explained in the Privacy Policy and GDPR & Data Security page, which form part of these terms.
Governing law
These terms are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, subject to any mandatory consumer rights that apply elsewhere in the United Kingdom.
